Miscellanea: NLRB Changes, FMLA Changes, Sovereign Immunity
FMLA amendments: Congress has passed, and Pres. Bush is expected to sign, amendments to FMLA that will provide leave to servicemembers and their families. The details are discussed in Connecticut Employment Law Blog and the FMLA Blog.
NLRB policy shifts: K&L|Gates (soon to merge with Hughes & Luce) has published “Changing Course at the NLRB,” the first part of which discusses changes made by the Republican majority in these areas: the recognition-bar doctrine, striker reinstatement, dues check off, and sample election ballots.
Alaska v. EEOC: The employee-intervenor has filed a petition for rehearing en banc with the 9th Circuit, on the issue of the state’s sovereign immunity from a claim under Government Employye Rights Act of 1991. Washington University Law professor Sam Bagenstos has joined with Anchorage practitioner Lee Holen in authoring the petition. They argue that the 9th Circuit’s opinion (previously covered here) conflicts with one from the 10th Circuit. H/T: Workplace Professor.
