Alaska Title 36 provides that 90 % of employees on a state-funded public contract must be Alaska residents, but also allows a contractor to obtain a waiver for a specific position.  The waiver is only prospective, and can’t exceed six months.

The state Department of Labor has now amended WHPL # 201 to conform to “recent regulatory amendments.,  which turn out to be 8 AAC 30.081(d) & (e).  Amended WHPL 201 (Mar. 3, 2008) may be found here

The new regulations do not appear on the Department’s official regulations page, but do appear on pages 30-31 of the PDF of the latest Pamphlet 400, posted on the Department’s website.
