Res Judicata, Genetic Discrimination
Res judicata and arbitration awards: Judge Ralph Beistline has granted res judicata effect to a confirmed arbitration award (in the securities industry). Keene v. Morgan Stanley, 2008 WL 2113387 (D.Alaska May 16, 2008). Note: I suspect the District Court is mis-identified and that Beistline was actually sitting in California, as the parties and attorneys are Californian, and the PACER data base for the District of Alaska does not include this case.
GINA: President Bush signed the Genetic Information Nondiscrimination Act (GINA) yesterday afternoon. The employment-related provisions of the Act don’t go into effect until November 21st of next year - 2009. The EEOC must issue regulations by May 21, 2009. For more on the Act, go to Employer Law Blog and Ohio Employer’s Law Blog. GINA requires an employee to file an EEOC charge, and bars disparate impact claims for at least the first six years.
