Enforcement of settlement agreement: A federal court lacks jurisdiction to address an alleged breach of a settlement agreement if it hadn’t retained jurisdiction over the agreement in the order of dismissal or incorporated the terms of the settlement agreement in the order of dismissal. Kiefer v. Lithia Motors, Inc., 2008 WL _______ (9th Cir. May 27, 2008)(unpub.)
Employer imposition of mandatory arbitration: An employer doesn’t violate Title VII when it fires an employee for refusing to sign a prospective mandatory arbitration agreement (one covering future disputes); but Title VII bars an employer from firing someone for refusing to submit a pending grievance to a new arbitration procedure. Goldsmith v. Bagby Elevator Company, Inc., 513 F.3d 1261 (11th Cir. 2008). Thanks to California Wage and Hour Law for the pointer.
