DAlaska: State Employee Challenges Union Security Clause

A State of Alaska employee has challenged the union security clause of the ASEA contract.  Robert Hunsick, a member of the General Government Unit, claims that the Alaska State Employees Association restrained his attempt to resign as a union member, and collected more than true agency fees. 

The ASEA/State contract provides a June 1-June 31 window for resignation of membership.  Hunsick tried to resign in December of 2007, and challenges ASEA’s continued collection of dues since then.  In his May 29th Complaint in federal court, Hunsick also claims that ASEA failed to provide him with post-resignation information about union expenditures.

  • Actually, I represent Mr. Hunsick. While the Foundation provides him with free legal aid, it does not represent him, as it is neither an attorney nor a law firm, but is a charitable legal aid organization under Section 501(c)(3) of the Internal Revenue Code.
