Police Officers File Whistleblower Suit Against City of Fairbanks

Two police officers have sued the City of Fairbanks, its Police Chief, and its Deputy Chief, claiming that the City demoted them in retaliation for raising concerns about pay, equipment, officer training, and nepotism.

In their Complaint, Al Hutton and Doug Wharton assert claims under the Alaska Whistleblower Act (AS 39.90), the federal Civil Rights Act (42 USC § 1983), and the common law (implied covenant).  According to the Fairbanks Daily News-Miner, the officers have also filed a grievance under the PSEA/City union agreement.

Linda Johnson of Clapp Peterson in Anchorage represents the officers.  Joe Evans of Silverdale, Washington, conducted an internal investigation for the City.

Hutton v. City of Fairbanks, 4FA-08-2090 CI.

07/11/08 Update:  I’ve uploaded the Complaint.
