Alaskan Legal Miscellanea
Other Alaskan blawgs: Peggy Roston has posted on QDROs and IRAs at Alaska Divorce Law Blog. Alicia Porter has posted on giving the Personal Representative the power to create a Special Needs Trust when drafting a will. And Paul Bratton, at Alaska Backwoods Lawyer, writes on a trademark infringement claim he is defending.
Alaska Juris F/V: That’s the name of a factory trawler fishing vessel, on which an employee was injured, etc. This morning’s 9th Circuit opinion in Aguilera v. Fishing Company of Alaska, Inc. leads to this holding: “maintenance and cure payments are subject to withholding for child support obligations, so long as those payment constitute income under relevant state law.” (The child support order was issued under Texas law, so there’s no immediate application to Alaska.) Michael Barcott of Holmes Weddle’s Seattle office represents the employer.
