DAlaska: Crack Trafficking Sentences

District Judge John Sedwick has rejected two prisoners’ attempts to reduce their sentences for cocaine base drug trafficking under the two-level reduction in the sentencing guidelines made retroactive by 18 USC § 3582(c). 

Dana Sweatt asked Sedwick to reduce her sentence from 84 months to 57 months.  Her original Guideline range was 121 to 151 months, but she had already received a reduction to 84 months; the two-level reduction would place her at a range of 100 to 125 months.  Sedwick refused to reduce her sentence a second time.  U.S. v. Sweatt, 2008 WL 3471529 (D.Alaska Aug. 11, 2008). 

Lenny Urena asked Sedwick to reduce his sentence from 108 months to not more than 87 months.  The new Guideline range is 87 to 108 months.  Sedwick refused any reduction.    U.S. v. Urena, 2008 WL 3471595 (D.Alaska Aug. 11, 2008).
