Mitchell on Palin and Violation of the Alaska Personnel Act
Alaska Statute 39.25.160(f) bars action affecting the employment status of a classified Alaska state employee on the basis of “a reason not related to merit.” Anchorage attorney Don Mitchell argues, in an article at The Alaska Dispatch, that Palin violated that statute in allowing (or encouraging) subordinates to pressure then-Public Safety Commissioner Walt Monehan to fire Trooper Michael Wooten. Mitchell notes that AS 39.25.900(a) provides misdemeanor criminal penalties for a willful violation of the Personnel Act, and Article II, Section 20 of the Alaska Constitution provides for impeachment by the legislature. AS 39.25.900(b) requires forfeiture of office upon conviction under .900(a).
