ELS: Employment Law and Troopergate

The next meeting of the Employment Law Section of the Alaska Bar Association will feature a panel discussing the various employment law issues presented by Troopergate. 

Some possible topics: 

1)  Does ex-Commissioner Monegan have any possible claim for wrongful termination?  (Are there some high-level employees who don’t even have a breach of covenant claim?) 

2)  Does Trooper Wooten have a claim for wrongful disclosure of personnel records?  (If so, must he present it in arbitration?) 

3)  Is there a private right of action under the state’s Ethics Act? 

4)  May an employer revise earlier discipline of an employee if it decides the earlier discipline was too lenient?  (Does the concept of double jeopardy apply to discipline?)  

5)  What records of a public employee are releasable under the Alaska Public Records Act and the state Personnel Act?

The Section meeting is Wednesday, November 5th, at 12 noon, at the offices of the Alaska Bar Association in Anchorage, and via teleconference.  Panelists will be announced shortly.
