The U. S. Supreme Court this morning held, 5-4, that a provision in a collective-bargaining agreement that clearly and unmistakably requires union members to arbitrate ADEA claims is enforceable as a matter of federal law. 14 Penn Plaza v. Pyett.
Greogory Fisher will file an analysis of the opinion for AEL.
