Alaska Legal Miscellanea: Vexatious Litigants, and Alaska’s Judicial Selection Plan
Sengupta v. UAF: The 9th Circuit this morning affirmed Judge Burgess’ dismissal of a former professor’s Title VII suit against the the University of Alaska. Burgess had dismissed the suit on res judicata grounds, holding that”Sengupta has litigated and lost this precise issue three times.” Burgess had also awarded the employer $15,860 in attorney fees, and entered a “vexatious litigant” order. Mark Ashburn of Anchorage represented the University. The employee was pro se.
Hinger v. Carpeneti: In this challenge to the constitutionality of Alaska’s Judicial Council plan, discussed earlier, Judge Burgess has recused himself. Judge Beistline now has the case.
