DAlaska: Attack on Medicaid Enrollment Moratorium

Several long-term care recipients of Medicaid have sued the federal government and the State of Alaska over  the feds’ moratorium on the processing of applications by Alaskans for  admission into four Home and Community-Based Services Medicaid programs.  The moratorium resulted from federal findings of problems in the State’s administration of the programs.    According to the Class Action Complaint, the moratorium violates the Medicaid Act, the Americans with Disabilities Act, and the 1973 Rehabilitation Act.

Plaintiffs are represented by Holly Johanknecht, Mark Regan, David Fleurant, and Wyvonne Martin Hill of the Disability Law Center of Alaska in Anchorage, by James Davis and Goriune Dudukgian of the Northern Justice Project in Anchorage, and Vance Sanders of Douglas.
