Annoying Defense Tactics: A Supplement
At today’s meeting of the Employment Law Section of the Alaska Bar Association, plaintiff’s attorney Linda Johnson supplemented her paper on annoying (and maybe counterproductive) defense tactics with these comments:
1. Some plaintiff’s counsel also use these tactics.
2. Plaintiffs attribute defense counsel’s personality and approach to the employer, and approach settlement discussions with these adverse opinions in mind.
3. Edit documents in a different format than the format you used for the initial draft. If you drafted at the computer, revise on hard copy. WBS: I’d add: Remember SpellCheck.
4. The primary target audience for pleadings is the judge, not opposing counsel.
