The 9th Circuit panel of Silverman, Rawlinson, and Clifton has affirmed Judges Beistline, Singleton, and Holland in appeals by one civil and two criminal defendants: U. S. v. Hymes, 2009 WL 3227087 (9th Cir. Oct. 8, 2009)(taxes and lien foreclosure); U. S. v. Braswell, 2009 WL 3166835 (9th Cir. Oct. 5, 2009)(sentence reduction under § 3582(c)(2); and U. S. v. Cruz, 2009 WL 3183121 (9th Cir. Oct. 5, 2009)(same, and re Amendment 709 non-retroactivity). All opinions are unpublished.
