9th Cir: Anti-retaliation Protections for Teachers of Students with Disabilities
The 9th Circuit has held that the anti-retaliation provisions of ADA Title II and the 1973 Rehabilitation Act protect aggrieved individuals without regard to whether they personally have disabilities. Thus, a teacher of students with disabilities may avail herself of the anti-retaliation remedies of those statues over her complaints that her school district employer constructively discharged her in response to her complaints about the adequacy of the district’s programs for her students. Senior District Judge James Singleton sat on the panel that remanded the District Court.
