Initiative on the unborn: AAG Michael Barnhill’s October 22, 2009, Attorney General’s Opinion on an initiative entitled “An Act recognizing the legal personhood of all human beings including unborn children” has been published at A.G. File No: JU2009-200-798, 2009 WL 3423983 (Alaska Oct. 22, 2009).
Barnhill concludes:
while we conclude there may be legal issues with the bill, it is not clearly unconstitutional. Therefore, we recommend that you certify the application. Consideration of legal issues that do not rise to the level of “clearly unconstitutional” must be deferred until after the election.
