9th Cir: Affirms Beistline on Polar Bear Regs

A 9th Circuit panel has, this morning, affirmed District Judge Ralph Beistline’s validation of U. S. Fish and Wildlife Service regulations under the Marine Mammal Protection Act that permitted a five-year period for non-lethal “takes” of polar bears and Pacific walrus in support of oil and gas activities around the Beaufort Sea. Robert Clayton Jernigan and Eric Jorgenson from Earthjustice in Juneau were local counsel for the plaintiffs. Center for Biological Diversity v. Kempthorne, ___ F.3d ___ (9th Cir. Dec. 2, 2009)
