9th Cir: Off-Premises Doffing and the FLSA
The 9th Circuit has held that police officers who don and doff their uniforms at home, when the employer gives them the opportunity to do so at work, are not engaged in compensable “work” under the FLSA. The court gave Skidmore deference to a 2006 USDOL opinion. Bamonte v. City of Mesa , ___ F.3d ___ (9th Cir. Mar. 25, 2010)
