DAlaska: Navigable Waters and the Clean Water Act
U S District Judge Ralph Beistline has held that Great Northwest’s wetlands (its gravel mining on 300 acres in South Fairbanks) are not “adjacent” to the Tanana River and therefore fall outside the definition of “waters of the
United States” as defined by 33 C.F.R. § 328.3. The wetlands
therefore fall outside CWA jurisdiction.
