Alaska Legal Miscellanea: Bad Faith Insurance Claims, and Attorney Ethics

Bad faith insurance claims:  U S District Judge Ralph Beistline has resolved several issues that arose where a buyer of toxic-contaminated land took an assignment against the sellers’ insurance carrier.  Beistline 1) rejected a bad faith claim (no jury could find there was a “substantial likelihood” of an excess verdict when the carrier rejected the settlement demand); 2) refused to apply the theory of coverage by estoppel; and 3) held that there canbe no liability for breach of the duty of good faith and fair dealing if there’s no coverage.  Hinkle v. Crum & Foster Holding, Inc., 2010 WL 2367494 (D.Alaska June 11, 2010).  Rick Friedman of Anchorage and Bremerton, WA, represents the plaintiff-buyer.  Gary Zipkin of Anchorage represents the carrier-defendant.
