Alaskan Arbitration: More Landau Awards
Two awards from Anchorage arbitrator Robert Landau have been published in the last several months.
In Kuspuk Sch. Dist. & Mid-Kuskokwim Ed’n Ass’n, 127 LA 930 (Landau, R., Arb., Mar. 18, 2010), Landau held that the CBA granted him no authority to enforce the state Ethics Act; held the employer hadn’t violated the CBA when it didn’t discipline the grievant’s co-worker for private conversations outside the work site; and held that the employer violated the CBA when it failed to develop a safety policy referenced by the CBA. Mark James, UniServ Director, represented the union; Brad Allen, Superintendent, represented the employer.
In Chugach Elec. Ass’n & IBEW Local 1547 , 127 LA 709 (Landau. R., Arb., Feb. 25, 2010), Landau held that the CBA required the employer to pay overtime for time spent at a medical exam (for a CDL) done, atypically here, after the end of the work day, and to pay the employee’s transportation costs as part of its agreement to “pay in full” for the exam. Bill Wielechowski, Associate General Counsel for Local 1547, represented the union; Robert Stewart, from the Anchorage office of Davis Wright, represented the employer.
