Alaska Supreme Court: Workers Comp Immunity for Project Owners, and Rule 68 Offers of Judgment
This past Friday the Alaska Supreme Court held that the Workers Comp immunity extended to “project owners” as part of the 2004 amendments to AS 23.20 applies to operators of indefinite-term non-construction businesses such as Alyeska Pipeline Service Company. The Court also held that a good faith Rule 68 Offer of Judgment made before the offeror knows the offeree’s legal and factual arguments, even when made in subjective good faith, doesn’t trigger Rule 68 liability.
